The agency had also expressed concerns over the indefinite intensity of nicotine and other chemicals in these. FDA was sued by Smoking Everywhere Inc. and NJOY, whose e-cigarettes were seized. The companies alleged that the agency had overstepped its authority. On Jan. 14, a U.S. District Court of the District of Columbia agreed to this argument. Judge Richard J Leon wrote, “There is no basis for FDA to treat electronic cigarettes … as a drug-device combination when all they purport to do is offer consumers the same recreational effects as a regular cigarette.” “FDA cites no evidence that [e-cigarettes] … are any more an immediate threat to public health and safety than traditional cigarettes, which are readily available,” the court observed, adding that FDA’s concerns did not in any way prevail over the economic harm sustained by the plaintiffs.

The study, led by psychologist Thomas Eissenberg, included 16 smokers. In four different phases of the study, each separated by two days, they were asked to: smoke a cigarette from their preferred brand; “sham smoke” a cigarette—or basically “puff” on it without lighting it; use an Njoy NPRO electronic cigarette filled with a 16mg nicotine cartridge; and use a Crown 7 Hydro e-cigarette filled with a 16mg nicotine cartridge. Both e-cigarettes’ batteries were fully charged for each “smoking” session.
Prior to the trials, smokers were asked to abstain from nicotine for 12 hours. At the beginning of each session, they had catheters inserted into their veins, enabling researchers to take blood samples multiple times—5, 15, 30 and 45 minutes after the first puff—to measure for nicotine content. They found that, as you would expect, actually smoking dramatically increased nicotine content in the blood. Yet, when it came to the e-cigarettes, both brands increased nicotine content only nominally more than sham smoking. What’s more, the products did little to reduce cigarette cravings.

Do electronic cigarettes actually work?
There are all sorts of products out on the market made to wean smokers off a dangerous habit—the patch, the lozenge, and the gum, for example. Yet, what about the e-cigarette? Though it’s marketed as a “safer” alternative to cigarettes, and not necessarily a smoking-cessation device, unlike the other nicotine delivery products, e-cigarettes—battery-operated devices that supposedly work by heating up a liquid nicotine substance which “e-smokers” inhale as vapor—aren’t regulated by the Food and Drug Administration (FDA). In fact, according to the American Medical Association, on January 14, a federal judge ruled that e-cigarettes should not be subject to FDA regulation because they are merely an alternative to traditional cigarettes, which are readily available. Medical experts counter that, though they may be marketed as alternatives to traditional cigarettes, people are turning to them as a smoking cessation product, which means that greater oversight is critical. In the midst of this heated debate, however, a researcher from the Institute for Drug and Alcohol Studies at Virginia Commonwealth University decided to put two brands of e-cigarettes to the test, to see just how they stack up against actual cigarettes. His findings, published in the February issue of the journal Tobacco Control, suggest that the e-smokes fail to deliver much nicotine, or help reduce cravings.

According to a federal judge, electronic cigarettes can no longer be classified as a drug delivery device. The judge said they are simply an alternative to tobacco and the companies manufacturing them are not making any health claims.
Those who support tobacco-control said that this ruling will open the flood gates to a large range of new nicotine-laced products that have been controlled by the FDA.
E-cigarettes have be growing in popularity at an alarming rate in the U.S. and around the world. E-cigarettes is a new technology which has sparked questions over the possible role of e-cigarettes as a smoking-cessation tool, though the World Health Organization has said it does not consider it to be a legitimate therapy.
For the most part, e-cigarettes are created to give a smoker a healthier option. It is a fact that it is more advantageous as compared with other smoking alternatives. Nicotine-free cigarettes have 0.05 milligrams of nicotine per cigarette, while low-nicotine cigarettes each have 0.3 milligrams. For comparison, light cigarettes have between 0.7 and 1.0 milligrams of nicotine.
The amount of air pollution put out by traditional cigarettes is mind blowing in comparison to the amount that an electronic cigarette puts out, since e-cigarettes are not lit and produce no smoke when not being used. Secondhand smoke is almost a non-issue.

A U.S. judge said the U.S. Food and Drug Administration doesn't have authority to regulate electronic cigarettes, dealing a blow to the agency's efforts to regulate tobacco products as drugs or devices.
In a 32-page opinion, U.S. District Judge Richard J. Leon sided with electronic-cigarette makers Smoking Everywhere Inc. and NJoy in finding that the FDA has no authority to regulate the products and can't stop them from entering the country.

Judge Richard J. Leon of Federal District Court in Washington issued a preliminary injunction in a lawsuit brought by two distributors of the so-called e-cigarettes, which are battery-powered tubes that heat liquid nicotine into an inhalable vapor and are meant to simulate the taste of tobacco.
